Terms of Service

These Terms govern your use of The Room ("we," "us," "the Service," available at theroom.chat). The Service is operated by Alex Avellaneda under the name The Room. By creating an account or using the Service, you agree to these Terms.

1. The Service

The Room is a multi-perspective AI discussion platform generating responses using third-party AI models (Anthropic Claude, OpenAI GPT, and xAI Grok) across several modes, including modes designed for open-ended personal reflection (Circle). The Room is a tool for exploring ideas and perspectives. It is not a substitute for professional advice — medical, legal, financial, or mental health — and you should not rely on it as such.

We may add, remove, or modify modes and voices, replace or change underlying AI models or providers, impose reasonable usage limits, interrupt the Service for maintenance or security, or discontinue a feature or the Service, at any time.

2. Eligibility

You must be 18 or older to use the Service.

3. Accounts

You're responsible for maintaining the security of your account and password. You must provide accurate registration information. You may not share your account or use it for anyone other than yourself.

4. Your content and our license to use it

You retain ownership of the messages and files you submit. You grant us a limited, non-exclusive license to host, process, reproduce, and transmit your content solely as necessary to provide and secure the Service, and to maintain and troubleshoot its technical operation. We do not use your conversation content to train our own models (see Privacy Policy, Section 3), and any other use of your content is governed by the Privacy Policy. You represent that you have the necessary rights and permissions for any content you submit, including documents or personal information relating to someone else.

5. AI-generated output

Output may be inaccurate, incomplete, biased, or offensive, and is not guaranteed to be unique — different users may receive similar or overlapping responses. You must independently verify anything you intend to rely on for a material decision. We do not guarantee that generated content is free of third-party rights or that you hold any exclusive right to it. Multiple AI "voices" disagreeing with each other, or with you, is a designed feature of the Service, not an error.

6. Credits, plans, and billing

Free plan. New accounts receive a one-time allocation of credits (currently 20) that does not renew.

Paid plan. We offer one paid subscription at $10/month, billed monthly through Stripe, automatically renewing until canceled. Paid subscriptions include a monthly credit allowance, currently 100 credits. When you first upgrade, this allowance is added to any free credits remaining in your account. At each subsequent successful monthly renewal, your balance resets to the monthly allowance; unused paid credits do not accumulate or carry over. Credits have no cash value and cannot be transferred, exchanged, or redeemed for money.

Payment processing. Payments are processed by Stripe. We do not store your full card details. You're responsible for any taxes applicable to your subscription.

Cancellation. Cancel anytime via the billing portal. Cancellation takes effect at the end of your current paid billing period; you keep paid access and your remaining allowance until then.

Account deletion is different from cancellation. Deleting your account cancels any active subscription immediately and permanently removes your access. You will not retain access until the end of your billing period, and no refund or credit is provided except where required by law. See Section 6 of the Privacy Policy for what deleting your account does to your data.

Refunds. Except where required by applicable law, payments are non-refundable and we do not provide prorated refunds for partial billing periods.

Failed or disputed payments. If a payment fails, we may restrict paid access while Stripe attempts to collect payment, and may cancel the subscription if payment continues to fail. A confirmed refund or payment dispute ends paid access and any remaining paid-tier allowance.

Price changes. We may change subscription pricing with reasonable advance notice; changes apply to your next renewal, not your current paid period.

Fraud and abuse. Usage obtained through fraudulent registration, abuse of free-tier allowances, or violation of these Terms may be forfeited, and the associated account suspended or terminated.

Service interruption during a paid operation. If a technical failure on our end or an upstream AI provider's end prevents an operation you've already been charged credits for from completing, we will make reasonable efforts to restore the unused portion of that charge to your balance.

The Service relies on third-party AI providers (Anthropic, OpenAI, xAI). We don't control, and aren't responsible for, the content those providers generate, their availability, or changes to their pricing or capabilities.

9. Not professional or emergency services

Automated crisis-language screening is a safety measure, not professional mental health support, and does not create a clinical relationship. If you are in crisis, contact local emergency services or a crisis hotline directly — do not rely on the Service in an emergency.

10. Disclaimers and limitation of liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, our total liability arising from your use of the Service is limited to the greater of the amount you paid us in the preceding 6 months, or $50. This limitation does not apply to liability that cannot be excluded under applicable law (for example, liability for fraud).

11. Termination

We may suspend or terminate your access where reasonably necessary to protect the Service, comply with law, address non-payment, investigate misuse, or enforce these Terms. This is separate from your own choice to cancel a subscription or delete your account (Section 6): cancellation preserves access until the end of your billing period, while account deletion is immediate. If we suspend or terminate your access for cause — including breach of these Terms, non-payment, or fraud or abuse under Section 6 — your paid access ends immediately, without a prorated refund, and unused credits and stored sessions may be deleted.

12. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of Thailand, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be subject to the jurisdiction of the courts of Thailand, except where applicable consumer law provides otherwise.

14. Language

These Terms are available in English and French. The French version is provided for convenience; in case of conflict between versions, the English version controls, except where applicable law requires otherwise.

15. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms are the entire agreement between you and us regarding the Service. Sections that by their nature should survive termination (including Sections 5, 6's billing-history implications, 10, and 13) survive.
